I. USERS

By accessing and/or using the Website, the User completely and unreservedly accepts the present General Terms & Conditions, as well as the Special Terms & Conditions that—where relevant—complement, modify or replace the General Terms & Conditions regarding particular services and content on the website.


II. USE OF THE WEBSITE, ITS SERVICES AND CONTENT

The User promises to use the website and its services and content without contravening current legislation, good faith, generally accepted use and law enforcement. Notwithstanding the above, Bauertypes reserves the right to refuse access to the website, at any time and without prior notice, to those Users who fail to fulfill these general conditions, or the special conditions that may be applied in each case.

The Bauertypes website puts connections and links to other websites that are managed and controlled by third parties at the disposal of the Users. The exclusive purpose of the aforementioned links is to facilitate Users’ search for information, content and services on the Internet, and should not be considered as a suggestion, recommendation or invitation to visit said websites. Bauertypes does not sell, manage, exercise prior control over, or own the content, services, information and statements available on said websites. VI. DISCLAIMER OF WARRANTIES AND LIABILITY

Bauertypes makes no warranty and does not accept liability, in any case, for damages of any nature that could be caused by: the lack of availability, maintenance and effective functioning of the website and/or its services or content; the lack of usefulness, suitability or validity of the website and/or its services or content to meet the requirements, activities, specific results or expectations of the Users; the existence of viruses, malware or harmful programs in the content; the receipt, obtaining, storage, circulation or transmission of content by users; the illegal, negligent, or fraudulent use of the website, its services, or content or use that is contrary to the present General Terms & Conditions, good faith, generally accepted use, or law enforcement of the website, its services, or content on the part of the Users; the lack of lawfulness, quality, reliability, usefulness and availability of services provided by third parties and made available to users on the website; third parties’ failure to fulfil their obligations or commitments regarding the services provided to Users through the website.


VII.- DURATION

The provision of the website service and the services is of indefinite duration. Notwithstanding the above, Bauertypes reserves the right to suspend, stop or terminate the provision of the website service or any of the services that it includes, according to the same terms found in the fourth term and condition.


VIII. INTELLECTUAL AND/OR INDUSTRIAL PROPERTY

All of the content on the website, including, but not limited to, text, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its graphic design and source codes (hereinafter “Content”), are the intellectual and industrial property of Bauertypes or third parties, and the rights of use over this content may in no way be understood to be ceded to the User beyond what is strictly necessary for the proper use of the website. The trademarks, trade names or distinctive signs and symbols are the property of Bauertypes or third parties, and access to the portal may in no way be understood to confer any right over the aforementioned trademarks, trade names and/or distinctive signs and symbols. For the purpose of protecting possible intellectual and industrial property rights, in the event that any User or a third party thinks that there has been a violation of his or her legitimate rights due to the inclusion of particular content on the website, he or she must notify Bauertypes of this circumstance, including: the personal details of the owner of the rights allegedly infringed upon; if the claim is presented by a third party other than the interested party, he or she must indicate on what authority he or she is acting; statement of the content protected by intellectual and industrial property rights and its location on the website; certification of the aforementioned intellectual and industrial property rights; and an express statement in which the interested party accepts liability for the veracity of the information provided in the notification.


IX. APPLICABLE LEGISLATION AND JURISDICTION

The present General Terms & Conditions is governed by Spanish legislation. Bauertypes and the User, expressly waiving any other jurisdiction to which they may be entitled, are subject to the Jurisdiction of the Courts and Tribunals of Barcelona for any issues that may arise or any actions that may be brought as a result of the provision of the website service and its services and content and for the interpretation, application, respect or violation of what is established in the present terms and conditions.
